Welcome to DiskPoint, a product of DUSKBAY LLC. By downloading, installing, or using DiskPoint (the "Software"), you agree to these Terms of Service. Please read them carefully before using the Software.
1. License & Ownership
DiskPoint is licensed, not sold, to you by DUSKBAY LLC. All intellectual property rights in the Software remain the exclusive property of DUSKBAY LLC. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Software except as permitted by law.
2. Acceptable Use
You agree to use DiskPoint only for lawful purposes. You may not use the Software to engage in any activity that is illegal, harmful, or infringes upon the rights of others.
3. No Warranty
DiskPoint is provided "as is" and "as available" without warranties of any kind, either express or implied. DUSKBAY LLC does not warrant that the Software will be error-free, uninterrupted, secure, or meet your requirements.
4. Data and System Risks
IMPORTANT WARNING: DiskPoint performs system-level operations including file scanning, analysis, and deletion. These operations carry inherent risks including but not limited to: permanent data loss, system instability, file corruption, and unintended deletion of important files. You acknowledge and accept these risks.
BACKUP RECOMMENDATIONS: DUSKBAY LLC strongly recommends maintaining frequent backups of all important data, not only before using DiskPoint but as a general precaution in the digital age. Regular backups protect against hardware failures, software issues, and other unforeseen circumstances beyond disk cleanup operations.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUSKBAY LLC DISCLAIMS ALL LIABILITY AND SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, BUSINESS INTERRUPTION, OR OTHER LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE.
YOU USE THE SOFTWARE ENTIRELY AT YOUR OWN RISK AND ASSUME ALL RESPONSIBILITY FOR ANY CONSEQUENCES, INCLUDING DATA LOSS OR SYSTEM DAMAGE.
6. Indemnification
You agree to indemnify, defend, and hold harmless DUSKBAY LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Software; (b) violation of these Terms; (c) any data loss or system damage resulting from Software use; or (d) any third-party claims related to your use of the Software.
7. Updates & Termination
DUSKBAY LLC may update, modify, or discontinue the Software, or terminate your license, at any time with or without notice. Upon termination, you must stop using the Software and delete all copies from your devices.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in California, and you hereby consent to personal jurisdiction and venue therein.
9. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and DUSKBAY LLC regarding the Software and supersede all prior agreements.

EFFECTIVE DATE: These Terms of Service are effective as of August 19, 2025.
By downloading, installing, or using DiskPoint, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Software.
